BACKGROUND:

 

These Terms and Conditions set out the terms governing the Karting Cave Prize Draw. The promoter of the Prize Draw is Karting Cave. Please read these Terms and Conditions carefully and ensure that you understand them before submitting your entry for the Prize Draw.

 

Karting Cave is a limited company registered in England and Wales under company number 15051868. Our registered address is 33 Gastons Rd, Malmesbury, Wiltshire, SN16 0BD and Our main trading address is as above.

 

By submitting an entry to the Prize Draw, you are agreeing to accept and be bound by these Terms and Conditions. If you have any questions, please contact Us at support@kartingcave.com . Please note that We reserve the right to refuse entry or refuse to award a prize to anyone who is in breach of these Terms and Conditions.

 

1. Definitions and Interpretation
   • In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

 

“Closing Date”	means the closing date of the Prize Draw, as set out in Clause 3;
“Draw Date”	means the date on which the winner[s] will be chosen, as set out in Clause 5;
“Opening Date”	means the opening date of the Prize Draw, as set out in Clause 3;
“Prize Draw”	SGS 2000W 2.8 kVA Heavy Duty Portable Petrol Generator
“We / Us / Our”     “Company”	Means Karting Cave Ltd, whose details are provided above.   Karting Cave Ltd.

 

2. Prize Draw Entry Rules
   • The Prize Draw is open to all UK residents aged 18 and above, subject to the following exceptions.
   • The following may not enter the Prize Draw:
     1. Our employees or their families; and/or
     2. Our agents, subcontractors, and any other third parties involved in or directly associated with the running of the Prize Draw.
   • Only one entry per household is permitted.

 

3. Opening and Closing Date
   • The Opening Date of the Prize Draw is 12:00pm on 21st May 2024.
   • The Closing Date of the Prize Draw is 19:00pm on 29th May  2024.
   • Entries received after the Closing Date will not be valid, accepted, or considered.

 

4. How to Enter the Prize Draw
   • No purchase is necessary.
   • Entrants must first sign up for an account with Karting Cave via our website – kartingcave.com. Setting up multiple accounts or on behalf of friends and/or family is not permitted and will result in the termination of those accounts and the removal of your original entry to the prize draw.
   • Entrants can enter the prize draw while it is available on kartingcave.com.
   • Open to legal residents of the United Kingdom who are 18 years of age or older at the time of entry.
   • Number of tickets and the pricing of each prize draw are set by the Company at its own discretion.
   • To submit your entry to the Prize Draw:
     1. Visit Our website at kartingcave.com and follow the instructions; or
     2. Enter by post at 33 Gastons Road, Malmesbury, Wiltshire, SN16 0BD, providing the following details: Entering by post for free ensures the prize draw is not classed as a lottery under the definition described by the Gambling Act 2005 and thus can be operated legally in Great Britain without the need for a gambling license. You must follow these instructions to enter by post: Send postcard or letter by Royal Mail including your full name, home address, date of birth, contact number, email address and your username for your Karting Cave online account. You must also include the correct answer and title of the competition you are entering and a signature confirming that you have read and accepted the terms and conditions stated on our website. If your postal entry is considered to be invalid, arrives after the closing date of the competition or does not include the correct information, your entry will be refused and you will not be contacted. Please ensure all details on your postal entry are present and correct. Entries should be posted to 33 Gastons rd, Malmesbury, Wiltshire, SN16 0BD. Free entries are treated the same as online entries and entries will be allocated a ticket number at random and these numbers will be presented in your online account. Only one entry per household will be counted. Bulk entries will be not accepted.
   • Please note that We do not accept any responsibility for any entries which are not successfully completed (e.g. lost or delayed) due to technical faults (including, but not limited to, hardware, software, and network faults) or for entries which We do not receive.
   • Entrants may enter the prize draw a set maximum number of times which is shown on each individual prize draw page.
   • You must enter the prize draw by the closing date of each prize draw in order to participate. Karting Caves website will serve as the master clock and as the master timekeeper for each draw. Any entry after this closing date will result in your entry being denied.
   • The Company reserves the right to refuse any entries to any of our draws at its own discretion.

5. The Prize Draw
   • A winner will be selected by random draw, which shall be performed using random number generator on Google and live streamed on our Facebook page on the Draw Date.
   • The Prize will be as follows:
     1. SGS 2000W 2.8 kVA Heavy Duty Portable Petrol Generator
   • The winner will be notified by email (using the details provided in their entry) within 24 hours after the Draw Date. The winner of each draw may be required to sign documents relating to subsequent press releases and produce identification to confirm that they are eligible to receive the prize. There will be no substitution or transfer of a prize.
   • If a winner does not respond to Us within 14 days of being notified, their prize will be forfeited, and We shall be entitled to select another winner using the process set out above. The Company will make every effort to contact the winner of the draw, however they will not be held responsible for any failure to receive notification for any reason.
   • The winner will be eligible to collect their prize after the closing date and is the sole responsibility of the Winner of each prize. The prize must be collected within 14 days of the closing date. Any longer will be at the Companies discretion and a storage fee maybe applicable.
   • Prizes are non-exchangeable and non-transferrable. No cash alternative is offered. We reserve the right to substitute a prize with an alternative prize of equal or greater value in the event that circumstances beyond Our control make it necessary for Us to do so.
   • Our decision regarding any aspect of the Prize Draw is binding and final. We will not enter into any correspondence about the decision.
   • We are required to publish or otherwise make available information which indicates that a valid award has taken place. The surname and county of major prize winners (and, where applicable, copies of winning entries) will be provided are available from Us by:
     1. Writing to Us at the below address.
     2. Karting Cave Ltd, 33 Gastons rd, Malmesbury, Wiltshire, SN16 0BD, enclosing a self-addressed envelope; or
     3. Sending an email to Us at support@kartingcave.com;

within 14 days of the Closing Date.

• If you object to any of your information, as set out above in sub-Clause 5.8, being published or otherwise made available, please contact Us by post or by email at support@kartingcave.com. Please note that We are still required to provide such information and winning entries to the Advertising Standards Authority on their request.
• We reserve the right to hold void, cancel, suspend, or amend the promotion if it becomes necessary for us to do so.

 

6. Limitation of Liability
   • Nothing in these Terms and Conditions limits or excludes your legal rights as a consumer. For more information on your rights as a consumer, please contact your local Trading Standards Office or Citizens Advice Bureau.
   • Nothing in these Terms and Conditions limits or excludes Our liability (or that of Our agents or distributors, or that of their employees) for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other form of liability that cannot be excluded or limited by law.
   • To the extent permitted by law, and subject to sub-Clauses 6.1 and 6.2, We (and Our agents and distributors) shall not be responsible or liable to compensate any winner and shall not accept any liability for any loss, damage, death, or personal injury, as a result of accepting a prize.
   • Karting Cave Ltd shall not be held liable in negligence, contract, statutory duty

 

7. Privacy and Personal Data

We will only use your personal information as set out in Our Privacy Policy, available from https://kartingcave.com/privacy-policy/, and as explained above in Clauses 5.8 and 5.9.

 

8. Law and Jurisdiction
   • These Terms and Conditions, the Prize Draw, and the relationship between Us and you (whether contractual or otherwise) shall be governed by, and construed in accordance with, English law.
   • Any dispute, controversy, proceedings, or claim between Us and you relating to these Terms and Conditions, the Prize Draw, or to the relationship between Us and you (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, or Scotland, as determined by your residency.
9. Indemnity

9.1 You agree to keep Karting Cave Ltd indemnified against all actions, claims, costs, expenses (including all legal costs) and damages brought against or suffered by Karting Cave Ltd arising out of any breach of these terms and conditions or any activity relating to your use of the Site (including negligent or wrongful conduct) by you or any other person accessing the Site using your name or any other name with which you have supplied to Karting Cave Ltd.

10. Severance

10.1 If any of these terms and conditions shall in whole or in part be held to any extent to be illegal or unenforceable under any enactment or rule of law such provision shall to the extent required be severed from the terms and conditions and rendered ineffective as far as possible without modifying the remaining provisions of this agreement and shall not in any way affect any other circumstances or the validity or enforcement of these terms and conditions.

10.2 The Competitions operated by Company via this Site are in no way associated with, endorsed, sponsored, or administered by Google, Apple, or Facebook. By using this Site and entering a Competition, Entrant agrees that Google, Apple, and Facebook have no liability and are not responsible for any administration or promotion of the Competitions available on this Site.

• Law and Jurisdiction

10.4 Each Competition operated by the Company shall be governed by and construed in all respects in accordance with English law and the parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction in respect of any dispute, suit, action, arbitration or proceedings which may arise out of or in connection with these terms and conditions provided that Karting Cave Ltd has the right at its sole discretion to commence and pursue proceedings in any other jurisdiction or jurisdictions whether concurrently or not. Void where prohibited or restricted by law
